1. About this Policy

This Privacy Policy (“Policy”) sets out information about how we, Ricoh Company, Ltd. (“RICOH”, “we”, or “us”), collect, process, and use personal data from natural person(s)(“you”, or “your”) in the course of providing RICOH360 services (“Services”) or through related websites managed by us (“Websites”). The Services include the RICOH360 Application (“Application”), RICOH360 Tours (“Tours”), RICOH360 Projects (“Projects”), and RICOH360 Cloud (“Cloud”).

What we mean by certain terms

In this Policy, “Personal Data” and “appropriate technical and organisational measures” shall be interpreted in accordance with all applicable Data Protection Legislation defined below. The terms “Controller”, “Processor”, and “Data Subject”, shall be interpreted in accordance with the EU General Data Protection Regulation (Regulation (EU) 2016/679) and the UK General Data Protection Regulation (collectively “GDPR”).

Any reference to “you” or “your” is a reference to all natural persons, whose Personal Data is processed by us, including but not limited to existing users of our Services and Websites, but also potential users, and end users of Third Party apps and services, to the extent that your Personal Data is processed by us.

“Data Protection Legislation” means the GDPR, the UK GDPR, the Act on the Protection of Personal Information (Japan), and all other applicable laws relating to processing of Personal Data, information security and privacy that may exist in any relevant jurisdiction.

“Third Party or Third Parties” shall mean any person or organisation other than you and RICOH. This shall include but not be limited to service providers and app developer providing services to you which use our Services and sub-processors which process Personal Data on our behalf.

Certain sections of this Policy apply only to users of certain Services (e.g. Tours, Application, or Cloud users), or from certain countries/territories. Where this is the case, the sections and the persons to which the sections apply shall be clearly indicated.

In particular, if you live in the European Economic Area (“EEA”) or the United Kingdom and the GDPR applies to your data, or if you live in Japan and Japanese Data Protection Legislation applies to your data, you shall respectively be referred to as a “user(s) located in the EEA or the UK” or a “Japanese User(s)”.

What if our other notices say different things

Additional information on our practices in relation to your Personal Data may be provided in other notices provided prior to or at the time of data collection. The Services and Websites may have their own documentation describing how we handle Personal Data for the Services or Websites specifically. To the extent a specific notice or documentation for the Services or Websites differs from this Policy, the specific notice or documentation will take precedence.

What this Policy does not apply to

This Policy does not apply to any Third Party websites or apps that you may use. We are not responsible for how Third Parties process your Personal Data even if they use our Services in the course of providing their services to you, if links on our Services and Websites lead to their services and websites, or if RICOH, RICOH THETA, or other logos associated with us are displayed on their services and websites. You should review the policies of any Third Party services or websites before accessing them.

2. RICOH as a Controller of Personal Data

RICOH may collect and process Personal Data when you provide it to us, either directly through our Services and Websites, or indirectly through Third Party apps and services as a user of those services.

When we decide how and why your Personal Data is processed, we are the Controller in respect of that Personal Data. Details regarding the types of Personal Data we process as Controller, why we do so, how we collect them, the lawful bases for our processing, and for how we retain them are as below. Please note that the “Lawful Basis” applies only to “users located in the EEA or the UK”.

With regard to the lawful bases for the processing, “Contract” and “Legitimate Interests” refer respectively to the bases described in Art. 6(1)(b) and Art. 6(1)(f) of the GDPR.

Legal Grounds for Our Processing of Your Personal Data (Applicable only to users excluding “users located in the EEA or the UK”)

The lawful basis on which we process your Personal Data is as follows:

• Where it is necessary to obtain your prior consent to the processing concerned in order for us to be allowed to do it, we will obtain and rely on your consent in relation to the processing concerned (see below for how to withdraw your consent at any time).
• We will process your Personal Data where the processing is necessary:

1. for the performance of a contract to which you are a party to or in order to take steps at your request prior to entering into such a contract;
2. for compliance with a legal obligation to which we are a subject; or
3. for the purposes of the legitimate interests pursued by us or another person, provided that this will only be in circumstances in which those legitimate interests are not overridden by your interests or fundamental rights and freedoms which require protection of Personal Data. For further details regarding legitimate interests, please contact us.

• In addition, we will process your Personal Data when such processing is permitted under the laws and regulations of each country.

Merger, Split-up, Business Transfer, etc (Applies users excluding “users located in the EEA or the UK”)

When a certain business is transferred to RICOH through merger, split-up, business transfer, etc. so that Personal Data is provided to RICOH, RICOH will use the Personal Data within the scope to which the individual has given consent, or within the scope necessary for accomplishing the purposes of use having been notified or announced before the transfer.

When there is a breach

We will notify the relevant supervisory authority within seventy two (72) hours where the breach is likely to result in a risk to individuals’ rights and freedoms and notify affected individuals without undue delay.

3.RICOH as a Processor of Personal Data

Besides as a Controller, RICOH may process Personal Data as a Processor. A Processor is a person or organisation that processes data on behalf of a Controller.

RICOH is a Processor when we process your Personal Data on behalf of a Third Party service provider using our Services. In this case, how we process your Personal Data will be governed by our agreement with the Third Party service provider.

RICOH360 Cloud is a service that provides cloud infrastructure and related functions to business customers ("Cloud Service Users") through APIs. In the RICOH360 Cloud service, RICOH processes Personal Data as a Processor based on the instructions of Cloud Service Users (Controllers).

RICOH will not use Personal Data processed in the RICOH360 Cloud service for its own purposes (including but not limited to analysis, sales promotion, improvement, and development of new products or services).

The storage location of data in the RICOH360 Cloud service (the United States or within the European Economic Area (EEA)) shall be determined by the Cloud Service User.

End users of the RICOH360 Cloud service should contact the Cloud Service User for details regarding the storage location and processing of their data.

If you believe that we are processing your data on their behalf, please consult with them first, because as Controller, they decide important aspects of the processing, including the purpose, lawful basis, and duration of the processing. They are also responsible for informing you of the processing.

Regardless of whether the Personal Data is provided by you through a Third Party, RICOH is always a Processor when it processes, to the extent they contain Personal Data, the following data provided to us:

1. 360-degree photos or videos, and other image data, drawings and other content, and associated metadata (including but not limited to date and time of capture, camera position information (GPS information), Wi-Fi access point name (SSID), and device information), and content derived therefrom.
2. Mail address, name, address, and phone number shared on Application and Tours for the purpose of sharing data with other Application and Tours users.
3. Usernames selected by users publicly displayed in Tours.

Where the Personal Data is provided directly to us by you, the details of the processing shall be as in the specific notices and documentation or in the agreements between you and us relating to the specific Service.

By using the Services, you indicate that you agree to fulfil all the responsibilities under applicable Data Protection Legislation as a Controller of the Personal Data contained in the items above.

4. RICOH’s Obligations as a Processor to the Controller (Applicable only to “users located in the EEA or the UK”)

As a Processor, RICOH shall:

1. Process the Personal Data only in accordance with documented instructions from the Controller, which may be specific instructions or instructions of a general nature.
2. Inform the Controller first (i) if we are required to process the Personal Data for any other purpose by applicable laws to which we are subject, unless such laws prohibit this on important grounds of public interest, and (ii) if we believe an instruction for the processing of Personal Data given by the Controller infringes applicable Data Protection Legislation,
3. Ensure that personnel required to access the Personal Data are subject to a binding duty of confidentiality in respect of such Personal Data.
4. Implement and maintain appropriate technical and organisational measures to protect the Personal Data against unauthorised or unlawful processing and against accidental loss, destruction, damage, theft, alteration or disclosure.
5. Take action immediately, in the event of a security breach, to investigate the suspected breach and to identify, prevent and mitigate the effects of the suspected breach and to remedy the breach and notify the Controller without undue delay.
6. Assist the Controller in fulfilling their obligations to respond to requests from Data Subjects exercising their rights.
7. Assist the Controller in relation to security, security breach notifications, and data protection impact assessments, including consultation with supervisory authorities,
8. Make available to the Controller information to demonstrate that the obligations set out in Data Protection Legislation relating to the appointment of Processors have been met.
9. Securely destroy or return such Personal Data to the Controller and delete existing copies, unless applicable laws require storage of such Personal Data, at the end of the Services, upon the Controller’s request.
10. Allow the Controller and its authorised agents to conduct audits or inspections during the term of the Agreement, provided if the full cost of the audit is borne by the Controller, save where assistance was required directly as a result of RICOH's own acts or omissions, in which case such assistance will be at RICOH’s expense.

5. Transfer of Personal Data to Third Parties

   (only for Tours Users) If you choose to post content through the “share” function, RICOH will provide information to such SNSs in accordance with your elections. You acknowledge and agree that you are solely responsible for your use of each SNS that you post content to, and that it is your responsibility to review the terms of use and privacy policy of the third party provider of such SNSs. We will not be responsible or liable for: (a) the availability or accuracy of any SNS; (b) the content, products or services on or availability of any SNS; or (c) your use of any such SNS.

   To the extent that the GDPR applies to the transfer of your Personal Data, we will carry out the transfer by complying with our obligations under the GDPR.

2. (Applicable only to users excluding “users located in the EEA or the UK”) RICOH will not provide Personal Data to third parties except in the preceding paragraph and in the following case

   (1) If prior consent has been received from you,

   (2) If the Personal Data is required to protect human life, limb, or property, and it is difficult to obtain the consent from you.

   (3) If it is particularly necessary to improve public health or promote the sound development of children, and it is difficult to obtain the consent from you.

   (4) If it is necessary to cooperate with a national agency, local public entity, or a person entrusted thereof with carrying out the affairs prescribed by laws and regulations, and there is risk that obtaining the consent from you will interfere with the execution of said affairs.

   (5) If a judicial or administrative organization demands provision of Personal Data according to laws and regulations.

   (6) If the recipient third party is an academic research institution, etc., and it is necessary for such third party to use the Personal Data for academic research purposes (including situations were a part of the purpose of using Personal Data is for academic research purposes but excluding situations where there is a risk of unfairly infringing on your rights and interests).

   (7) If RICOH provides the Personal Data to other parties because of merger, split-up, business transfer, etc.

   (8) RICOH may share your Personal data with our subsidiaries, joint ventures, or other companies under a common control (“Affiliates”). The Personal Data we may share with such Affiliates are limited to necessary data, such as name, company name, address, phone number, email address, contract information, purchase history, payment information, IP address, etc. and the purpose of use by such Affiliates are described in the purpose of use described in Article 2 of this Policy. The data is managed responsibly by our representative described in Company Data. We will require our Affiliates to honor this Policy.

   (9) If Data Protection Legislation allows such provision.

Payment Processing Information

For online payments, RICOH use the payment services of Stripe directly or through the intermediary of RICOH's affiliates. RICOH and RICOH's affiliates if applicable do not process, record or maintain your credit card or other related information necessary to complete your payments. 6. Transfer of Personal Data to Other Countries/Territories

6.1 For European Users

(Applicable only to European Users.)

Your Personal Data will be stored on servers located in the following regions, depending on the service you use:

As our business is global, your Personal Data may be disclosed to our group companies located in regions outside the United Kingdom and the European Economic Area (EEA) (including the United States of America, the United Kingdom, Canada, and Japan) for the purposes of service maintenance and operation, quality improvement, technical support, and similar purposes. Even where data is stored on servers within the EEA or the UK, such data may be accessed from regions outside the EEA or the UK for the purposes described above. Where the level of data protection in these regions is not considered adequate, we will implement appropriate safeguards as set out in the table below to ensure that your Personal Data is protected.

If you are a Japanese User, Addendum I to this Policy below applies to you. Please refer to Addendum I.

If you are not a user located in the EEA nor a Japanese User, we may disclose to the parties outside of the EEA including the United States of America, Canada, the United Kingdom (EEA Personal Data only), the EEA (UK Personal Data only), and Japan, in accordance with applicable laws and regulations, and this Policy.

7. Data Subject Rights

1. If you are a user located in the EEA or the UK, provided the legal conditions are met, you have the following rights in relation to Personal Data relating to you that RICOH processes:

   • The right of access - the right to require free of charge disclosure of the Personal Data concerned
   • The right to rectification – the right to correct any incomplete or inaccurate Personal Data about you
   • The right to erasure - the right to request us to delete your Personal Data
   • The right of data portability - the right to receive the Personal Data concerning you in a structured, commonly used and machine-readable format or to have your Personal Data transmitted directly to another company, where technically feasible
   • The right to restrict processing - the right to halt the processing of your Personal Data
   • The right to object – the right to object to us processing your Personal Data on the basis of our legitimate interests (or those of a Third Party), including processing for direct marketing purposes or profiling for purposes of direct marketing, or where we are performing a task in the public interest, excepting where the processing is based on compelling legitimate grounds or is needed for the exercise or defence of legal claims that may be brought by or against us

   These rights may be limited, for example if fulfilling your request would reveal Personal Data about another person, or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep.

   If you wish to exercise any of these rights, please contact us at the contact details set out below.

   Wherever we rely on your consent, you have the right to withdraw that consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. We may however have other legal grounds for processing your data for other purposes, such as those set out above.

   In some cases, we are able to send you direct marketing without your consent, where we rely on our legitimate interests. You have an absolute right to opt-out of direct marketing, or profiling we carry out for direct marketing, at any time. You can do this by following the instructions in the communication where this is an electronic message, or by contacting us using the details set out below.

   If you are a Tours user, Tours uses user IDs provided by Third Parties, Facebook, Inc. and Twitter, Inc. The registered content for these services is not managed by RICOH. If you have inquiries, you should contact them.

2. If you are not a user located in the EEA or the UK

   (1) you have the following rights in relation to Personal Data relating to you that RICOH processes

   • The right to require free of charge (i) disclosure of the Personal Data concerned (in addition, you may request access to third party transfer records, where legally applicable) (ii) access to and/or (iii) duplicates of the Personal Data retained.
   • Where legally applicable, the right to request proper rectification, removal or restriction of your Personal Data
   • Where legally applicable, in case processing of your Personal Data is either based on your consent or necessary for the performance of a contract with you and processing is carried out by automated means, the right to receive the Personal Data concerning you in a structured, commonly used and machine-readable format or to have your Personal Data transmitted directly to another company, where technically feasible (data portability);
   • Where legally applicable, in case the processing of your Personal Data is based on your consent, the right to withdraw your consent at any time without impact to data processing activities that have taken before such withdrawal or to any other existing legal justification of the processing activity in question;
   • The right not to be subject any automatic individual decisions which produces legal effects on you or similarly significantly affects you; and
   • The right to take legal actions in relation to any breach of your rights regarding the processing of the Personal Data, as well as to lodge complaints before the competent data protection regulators.
   • Ricoh doesn’t manage registered content provided by a party other than RICOH, namely Facebook, Inc. and Twitter, Inc. Please contact the provider for inquiries.

   In addition, you may object to the processing of the Personal Data, at any time if we are processing Personal Data relating to you on the basis of legitimate interests.

   (2) When you wish to submit a request regarding the usage of your Personal Data for the Services, please contact at the contact information set forth in Article 12 hereof. Persons making inquiries may be asked to confirm that they are the data subject or a legitimate agent of the data subject. Notwithstanding the above section, we may ask you to bear a reasonable fee for requests for disclosure, etc. For details, please contact the inquiry window described in Article 12 of this Policy.

   (3) Please be aware that requests may not be granted in cases in the following categories:

   • If the requester cannot confirm that they are the data subject or a legitimate agent of the data subject.
   • If your request is relating to Personal Data of other individuals.
   • If disclosure of Personal Data is likely to harm the life, body, property, or other rights or interests of yours or another individual.
   • If disclosure, deletion, or cessation of use of Personal Data is likely to seriously impede the proper execution of our business.
   • If disclosure of Personal Data held by RICOH violate other laws or regulations.
   • In the case of requests being manifestly unfounded, not based on facts or excessive, in particular because of their repetitive character.
   • In the case of a request for deletion or cessation of use of Personal Data held by RICOH if, to the extent that processing is necessary: for exercising the right of freedom of expression and information; for reasons of public interest in the area of public health; for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in so far as the right for deletion is likely to render impossible or seriously impair the achievement of the objectives of that processing; or for the establishment, exercise or defence of legal claims.
   • If your request for deletion or cessation of use of Personal Data is not based on our violation.
   • If it is difficult to suspend the use of Personal Data held by us and your rights and interests can be protected by alternative means; or
   • RICOH is otherwise permitted under applicable laws to refuse your request.

8. Technical and Organisational Measures to protect Personal Data and other protective measures

RICOH has implemented appropriate technical and organisational measures to protect your Personal Data from misuse or accidental, unlawful, or unauthorised destruction, loss, alteration, disclosure, acquisition, or access, as well as other forms of unlawful processing.

We also use encryption technologies such as SSL (secure sockets layer) to prevent information theft by a third-party during communication when you provide Personal Data via our Services and Websites. Encryption technologies using SSL is used to prevent information theft etc. by a third-party during communication when you provide highly confidential information such as Personal Data via this Service and Websites. It may not be possible to use these technologies depending on your devices (including, but not limited to computer or mobile phone). In this case, please be aware that you may not use this Services and Websites.

RICOH has stipulated that Personal Data used for business operations will be handled under appropriate protection in accordance with laws and regulations in the Ricoh Group Code of Conduct and the Ricoh Group Personal Information Protection Basic Regulations, which is one of the Ricoh Group Standard. RICOH implements appropriate safety management measures to laws and regulations, guidelines and those internal regulations to prevent leaking, loss, destruction, etc. of Personal Data, and works to protect Personal Data retained by RICOH. RICOH also trains its employees on appropriate handling of Personal Data, etc. and works to fully ensure the protection of this information.

9.Handling of Access Log Information, etc.

1. Use of Google Analytics

RICOH uses Google Analytics, a web analytics service provided by Google Inc. (“Google”), 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Google Analytics uses Cookies, which are text files placed on users’ devices, to help the Services and Website analyze how users use the Services and Website. The information generated by the Cookie about the use of the Services and Websites (including your IP address) will be transmitted to and stored by Google on servers in the United States of America. In case of activation of the IP anonymization, Google will truncate/anonymize the last octet of the IP address. Only in exceptional cases, the full IP address is sent to and shortened by Google servers in the USA. Google will use this information for the purpose of evaluating your use of the Services and Websites on RICOH’s behalf, compiling reports for RICOH and providing RICOH with other services relating to services activity and internet usage. Google will not associate your IP address with any other data held by Google. You may refuse the use of Cookies by selecting the appropriate settings on their browser and app. However, in that case, it may not be possible to use the full functionality of the Services and Websites.

Google Analytics collects access log information via cookies.

2. Links to Websites Other than This Websites

Links to the websites of companies related to RICOH or third-party companies (hereinafter "Websites Managed by Third Parties") are placed in some areas of the Websites to improve convenience for you. Accessing these links may take you away from RICOH's Websites. Although RICOH or RICOH THETA logo may be displayed on some parts of the Websites Managed by Third Parties, RICOH is not involved in the content posted on the Website Managed by a Third Party and does not accept responsibility for the website's handling of Personal Data.

Websites Managed by Third Parties may issue Cookies, gather data or gather Personal Data according to their own policies. This Policy does not apply to the handling of information on other, linked websites. Therefore, in the event that you access a Website Managed by a Third Party, RICOH recommends that you read the policies of the Website Managed by a Third Party relating to protection of Personal Data before providing Personal Data.

3. Access Log Information

The Services and Websites may automatically collect your technical or usage information including details regarding your access and use, browser type and version, page browsing history, IP address, operating system and device information (hereafter referred to as “Access Log Information”). We may process the Access Log Information for the purposes listed in Article 2 of this Policy.

10.Cookie Policy

Cookies are small text files that are automatically downloaded to your browser or device when you visit a webpage. RICOH uses cookies and other similar technologies (e.g. Web Beacons and Flash Cookies) in order to enhance your experience using the Service and Websites. In this Policy, we shall refer to them collectively as Cookies.

Our Websites may use Cookies for the following purposes:

• To identify your browser or you and reduce the work required for authentication.
• To assess usage of the Services and Website and make improvements.
• To better understand how you use the Services and Websites so that we can improve your user experience.

Different Types of Cookies

There are different types of Cookies:

1. Strictly Necessary Cookies. These are Cookies that are required for the operation of the Services and Websites. They include, for example, Cookies that enable you to log into secure areas of the Services and Websites. We may use these Cookies without your consent. You cannot opt out of these Cookies. 11.Personal Data Belonging to Minors

RICOH does not collect Personal Data from minors without the consent of the legal guardian, and even then, only if it is legal under applicable laws and regulations. If it becomes known to us that we have collected Personal Data from a minor without the legal guardian’s consent, we will delete the Personal Data and any associated user account.

If you are a user located in the EEA or the UK, we deem that you are a minor if you are below the age of sixteen (16), and will not collect or process Personal Data from you even if your legal guardian consents. If it becomes known to us that we have collected Personal Data from a minor, RICOH will delete the Personal Data and any associated user account.

14. Updates to this Policy

RICOH may update this Policy in response to changes to or improvements of the purposes of use, improvement of safety, or according to revisions of related laws, regulations and rules. Therefore, we recommend that you periodically check this Policy on the Website.

15. Controlling Text

The governing language of this Policy is English. Only the original English language version of this Policy shall be valid and effective. Please see Addendum I if you are a Japanese User.

Addendum I: Information For Japanese Users

Notwithstanding any other provisions of this Policy, if you are a user located in Japan, the governing language of this Policy shall be Japanese. Only the Japanese version of this Policy shall have effect as this Policy, and any translations of this Policy shall have no effect under this Policy or otherwise.
